A Client's Challenge: A Disappearing Debtor

Recently, a client approached us with a significant debt owed by a customer. Despite repeated attempts to collect the payment, our client was unable to reach the debtor. The debtor had seemingly vanished, leaving no forwarding address or updated contact information.

Step 1: Tracking Down the Debtor

The first step involved locating the debtor's current address. Utilising a reputable online tracing service, we were able to track down the debtor's updated contact information. This crucial step allowed us to move forward with the debt collection process.

Step 2: The Power of a Letter Before Action

With the debtor's address confirmed, our client drafted a robust Letter Before Action (LBA) using the templates within the member's area. This formal letter clearly outlined the outstanding debt and the consequences of non-payment. An LBA template is available to our member's area, but it's crucial to ensure the letter is tailored to the specific circumstances of each case.

Step 3: A Positive Outcome

The LBA served as a powerful reminder of the outstanding debt. Following receipt of the letter, the debtor promptly contacted our client and settled the entire amount owed!

This case exemplifies the effectiveness of a well-crafted Letter Before Action. Often, simply outlining the legal repercussions and potential consequences is enough to prompt debtors to settle their outstanding balances.
